Jacob is 9 yrs old, Levi is 6 years old and Jenny is 2yrs old. Kim and Travis live in a 2 bedroom unit in Sale. Kim has never worked and Travis occasionally works as a brick layers labourer. Travis currently doesnt have any work. Kims family live in Bendigo, Travis family live in Melbourne. When Jacob was 2yrs old Child Protection received a report in relation to substance misuse. The reporter informed that the parents were using cannabis allegedly every day and that Jacob was always present. Child Protection spoke to the parents who informed them that Jacob attended a child care centre and was therefore not around every day. Protective workers phoned the child care centre , no concerns were raised. The parents confirmed that they used cannabis on the weekends agreed to engage with and drug and alcohol service and the case was closed. A further notification was received after the birth of Levi. The reporter informed that the father attended the hospital substance affected and presented as highly agitated. The parents were visited at the hospital where no further concerns were found. The parents were again visited at home and a SIDS safety check was conducted. No further concerns were raised. The case was closed. Six months ago another notification was made where Kim was seen to be verbally abusing and yelling at Jenny. Child Protection interviewed Kim and Travis who disclosed that they were struggling financially and that on some occasions they could not afford to buy food. The protective workers observed a bong on the coffee table and questioned the parents about their alleged drug use. The parents admitted to using cannabis and acknowledged that this could be the reason they were unable to afford food. Child Protection spoke to the familys Maternal Child Health Nurse (MCHN) who advised that the parents struggled financially, their parenting capacity was very basic and that they are very critical of Jacob. At the time of the notification DoHS were asked by the courts to investigate under S 91B of the Family Law Act 1975 as the parents were going through Family Law Court proceedings following an episode of family violence. During the course of these proceedings the parents had reunited and had applied to have the Family Law matter vacated. Concerns were raised in regards to the likelihood of the children being exposed to family violence and that Travis is alleged to inappropriately discipline the children. The parents agreed to engage with a drug and alcohol service, Kim agreed to engage with family violence counselling, Travis with a Mens Behavioural change program and no further protective concerns warranted statutory involvement so Child Protection closed. Five weeks ago a third notification was received by Child Protection regarding a child crying for hours one night and hearing a man thought to be the childs father swearing and yelling. During the same day another notification was received whereby Jacob had disclosed to his teacher that his father had hit his mother. The school further discussed their concerns regarding the behaviours of both Jacob and Levi. The school stated that the two brothers fight physically with each other and often punch and kick other children. That the parents attend the school for meetings and appear to acknowledge the problem, take on suggestions about managing their sons behaviour however the behaviour continues and the parents are increasingly difficult to contact. The school stated that Levi had difficulty concentrating in class and would withdraw and become anxious if the teachers raised their voices regardless if it was directed at Levi or another child. The school stated that Jacob told his teacher he wanted to kill himself. The teacher referred him to the school psychologist however she has not been able to gain parental consent to see Jacob. The psychologist has observed Jacob in class and in the play ground and is of the belief that he suffers from Conduct Disorder and possibly ADHD. Protective workers visited the home. On arrival they found Kim with a swollen bloodied lip, the unit was extremely cluttered with dirty nappies and beer bottles. Jenny was asleep in a stroller in the lounge room and there was no-else home. Kim informed the protective workers that Jacob and Levi were at school and Travis had left the unit yesterday after they had fought, Kim did not think Travis would be returning home. After further discussion Kim disclosed that Travis had assaulted her but that she was scared to call the police. Kim informed protective workers that Jenny was sleeping in the stroller because her cot had been broken during another argument with Travis. Kim broke down in tears and stated that her eldest son Jacob was misbehaving and continually punching Levi sometimes in the head. Kim said that she feels she is unable to control her children, that she is a nervous wreck because of them little shits and needs Travis to return to the unit so that the boys will stay in line. The protective workers observed Jenny approached Kim when she was crying, Kim appeared to be unaware of Jennys presence, Jenny repeatedly said mommy however Kim ignored her. Jenny climbed up onto the couch and tried to climb onto Kim, Kim then pulled her onto her lap and Jenny struggled to be free of Kims arms. The protective workers explained that should Travis return to the home that the children along with herself would be at risk. The workers explained that Kim would need an IVO, Kim refused.
